Hi! Cliff Unruh here, owner of 401. Our work group met last evening to discuss the management company’s lack of cooperation and what things we need to do in preparation for the 18th At Walden’s most important assembly of the Co-Owners in decades. We are clearly on a path that is in full compliance with our By-Laws and Texas State Law. While I don’t have the most up-to-date figures, I believe it is safe for me to say that more than 33% of us have signed an official document calling for this Special Meeting! Article II, Section 6 of our By-Laws says it only requires 10% of us and Texas Law says that if the By-Laws don’t specify otherwise then 20% of the Co-Owners can call a Special Meeting. We are way beyond both of those thresholds and yet we cannot get the management company, Texas Glocal Partners, to even give us the official list of Co-Owners so that we can reach everyone! They required us to make our requests by certified letter and have hidden behind the argument that your and my contact information is “confidential.” According to them, we are not supposed to know each other’s identity. How, in heaven’s name are we to self-govern and follow the provisions of our By-Laws then? Well, we did the only thing we could do…we hand compiled a list of owners from the 100% public database (so much for “confidential”) of the Montgomery County Tax Assessors Office.
On September 26 my wife, Melody, and I together with Mario Rosales (908) drove to Texas Glocal Partners in Magnolia to hand deliver official notification that “more than 10%” of the Council of Co-Owners were calling a Special Meeting. We informed them of their need to remain neutral and impartial. We also formally requested the official list of Co-Owners with their proper mailing addresses as well as other contact information, the same information that the 3-member non-elected board has access to any time they desire. They essentially stonewalled us. Since then we have sent three more requests (including the one sent by certified letter) and their responses have been minimal.
Last evening our work group decided that every single owner at the 18th at Walden deserves to see at least some of what we have been doing behind the scenes on everyone’s behalf. I encourage you to read this most recent notification sent to Texas Glocal Partners. This document spells out all the ways Texas Glocal Partners has both overtly and, not so overtly, worked against the Council of Co-Owners. One last important detail: Have you filled out and signed your proxy for this meeting? Even though you plan to be there Saturday morning, October 21st at 10:00 at the clubhouse, we still need your proxy! Your signed proxy (see top of this page) allows you to be counted as present, even if you are detained or something happens to keep you from the meeting. We need 40% of the Co-Owners present in person or by proxy in order to meet the quorum requirement. With quorum that meeting is 100% official; something that has not happened at “the 18th” in a long time.
